Terms and Conditions for Spoofmon

Important Notice

Welcome to Spoofmon! These Terms and Conditions ("Terms") govern your access to and use of the DMARC reporting services provided by Spoofmon ("Spoofmon," "we," "us," or "our").

By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.

1. Definitions

  • Service(s): Refers to the DMARC reporting and monitoring services provided by Spoofmon, including all features, functionalities, and related support.

  • User(s) / Customer(s) / You: Refers to any individual or entity that registers for, accesses, or uses the Services.

  • DMARC Reports: Refers to aggregate reports and failure reports generated by email providers and ISPs regarding your domain's email authentication status.

  • Domain Authentication: Refers to email authentication mechanisms including SPF, DKIM, and DMARC that help verify the legitimacy of email messages.

  • DNS: Domain Name System.

  • DKIM: DomainKeys Identified Mail.

  • SPF: Sender Policy Framework.

  • DMARC: Domain-based Message Authentication, Reporting, and Conformance.

2. Acceptance of Terms

By registering for an account, accessing, or using any part of the Spoofmon Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. These Terms constitute a legally binding agreement between you and Spoofmon.

3. Service Description

Spoofmon provides DMARC reporting and monitoring services primarily designed for domain authentication and email security. Our Service is specifically engineered for:

  • DMARC report collection and analysis

  • Domain authentication monitoring

  • Email security analytics

  • Other legitimate domain monitoring purposes

Note: The Service focuses on providing DMARC reporting and domain authentication monitoring to help protect your email domains from spoofing and phishing attacks.

4. User Obligations and Responsibilities

As a User of Spoofmon, you agree to:

  • Domain Ownership/Access: You must own or have full administrative access to any domain name that you add to our monitoring service. This is required for proper DMARC configuration and report collection.

  • Valid Contact Information: All contact information provided must be accurate and up-to-date to ensure you receive important notifications about your domain's authentication status.

  • DNS Configuration: You are solely responsible for correctly configuring your DNS records, including DKIM, SPF, and DMARC, according to best practices. Proper configuration is essential for effective domain authentication monitoring.

  • Prohibited Activities: You shall not use the Service to:

    • Monitor domains you do not own or have authorization to monitor

    • Attempt to access other users' data or reports

    • Interfere with the Service's operation

    • Violate any applicable laws or regulations

  • Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify Spoofmon immediately of any unauthorized use of your account or any other breach of security.

  • Accurate Reporting: You acknowledge that DMARC reports depend on external email providers and ISPs, and Spoofmon cannot guarantee the completeness or timeliness of all reports from third parties.

5. Service Plans and Usage

  • Service Tiers: Spoofmon offers various service plans with different limits on the number of domains that can be monitored and the frequency of report processing.

  • Domain Monitoring: Plans may include limits on the number of domains you can add to the monitoring service.

  • Report Processing: We collect and process DMARC reports from participating email providers and ISPs. Report availability may vary based on third-party reporting schedules.

  • Usage Notifications: You may receive notifications about your domain's authentication status, policy violations, or service usage limits.

  • Service Limits: If you reach your plan's domain monitoring limits, you will need to upgrade your plan or remove existing domains to add new ones.

6. Payment and Billing

  • Payment Processing: All payments for Spoofmon services are processed securely through Stripe. We accept various payment methods supported by Stripe, including credit cards, Google Pay, and Amazon Pay. For details on Stripe's terms, please refer to Stripe's Terms of Service.

  • No Payment Information Storage: Spoofmon does not store your payment card details or other sensitive payment information. All such information is handled directly by Stripe.

  • Subscription Management: You can manage your subscription and payment methods directly through your account, which integrates with Stripe.

  • Billing Cycle: Subscriptions are billed according to the chosen plan (e.g., monthly, annually).

7. Cancellation and Refunds

  • Cancellation: You may cancel your subscription at any time. Your Service will remain active until the end of your current billing period, after which it will terminate.

  • Refunds: Refunds are generally not provided for Services already rendered. A refund may be issued only if Spoofmon is unable to provide the Services due to:

    • Technical issues preventing access to your DMARC reports and dashboard.

    • Inability to collect DMARC reports for your verified domains.

  • Credits for Downtime: In the event of significant Service downtime exceeding four (4) continuous hours that is directly attributable to Spoofmon, a credit may be issued against future service fees at our sole discretion.

8. Data Handling and Privacy

  • DMARC Report Data: Spoofmon collects and processes DMARC reports from email providers and ISPs. These reports contain aggregated data about your domain's email authentication status and do not include email content.

  • Data Storage: We store DMARC report data, domain configurations, and account information necessary to provide our monitoring services.

  • Inactive Account Data: When you cancel your service, your account information will remain in an inactive state in our system to facilitate potential reactivation.

  • Data Erasure Request: If you wish to have your data completely erased from our systems, please contact us via our contact page or support email.

9. Disclaimers and Limitation of Liability

  • No Guarantee of Complete Reporting: While Spoofmon makes every effort to collect and process DMARC reports, we do not guarantee that all reports will be available. DMARC reporting depends on third-party email providers and ISPs, and some may not send reports consistently or at all.

  • No Business Impact Responsibility: Spoofmon shall not be held responsible or liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from the inability to use the Service or incomplete DMARC reporting.

  • Service "As Is": The Service is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Termination

Spoofmon reserves the right to suspend or terminate your account and access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms, fail to make payment, or engage in any form of abuse of the Service.

Upon termination, your right to use the Service will immediately cease.

11. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the jurisdiction where Spoofmon is registered, without regard to its conflict of law provisions.

Any dispute arising from or relating to the subject matter of these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
